The court hearing for Sam Lutfi vs. Lynne Spears in the defamation and libel case was scheduled for the end of January, but according to recently filed court docs, the hearing is now post-poned for a later date, and a new judge was assigned to the case.
From the court docs:
“This case is ordered returned to Department 1 for re-assignment or trial. Scheduled hearings, if any, sit in Department 10 are herby advanced to today are vacated. Counsel for defendant to give notice to all appearing counsel.”
The conservators want to keep Britney from being deposed by Lutfi, who’s disputing allegations he cut off her phone lines and gave her drugs. If Britney’s free from the conservatorship, she’s susceptible to this lawsuit and may have to go to court in person and recount the days of her public breakdown.
Lynne was pressured to submit a deposition in November after fibbing to her own lawyers about her whereabouts. She told her lawyers she couldn’t partake in the deposition because she was “out of the country” (claiming she was in South America on Britney’s tour), but in actuality she attended Jamie Lynn’s country performance in Nashville, Tennessee – telling People magazine “I am so emotional tonight” after seeing the show.
Lynne’s defense claimed it was her intention to leave the country.
The court docs state:
“Mrs. Spears’ attorneys originally gave the impression they would voluntarily produce Mrs. Spears in Los Angeles to save legal fees – provided Plaintiff’s counsel was patient. That was a dilatory tactic and they never provided a date. Ultimately, Plaintiff’s counsel formally noticed the Lynne Spears deposition for Baton Rouge, Louisiana, but Mrs. Spears refused to be deposed, falsely claiming she was out of the country, when she wasn’t.
