Britney Spears’ custodial rights may have been reduced due to a physical altercation between Jamie Spears and her 13-year-old son, Sean.
UPDATE: A judge granted Britney’s sons a restraining order against Jamie Spears. Read more about that here.
Kevin Federline was awarded more custodial rights to his two sons with Britney Spears. TMZ reported it’s due to Britney’s supposed declining mental state, however new reports paint a different picture.
Federline filed a police report against Jamie Spears for allegedly physically abusing Britney’s eldest son, Sean.
The Blast reports K-Fed filed the battery report at the sheriff’s office the day after the altercation when the boys were in Britney’s possession. They claim Sean and Mr. Spears got in an argument. Sean went to his room and locked the door because he became increasingly fearful of Jamie’s mood. That’s when Mr. Spears allegedly broke down Sean’s door and “violently shook” him.
Britney reportedly removed the kids away from Mr. Spears and brought them back to her home. Federline picked them up later in the evening.
In the eyes of the law, it looks like Britney put the boys in harm’s way by having Mr. Spears in proximity, and as a result he was granted more custodial rights. The couple previously agreed to 50-50, but a new ruling gives Kevin 70%. This could very well be a result from the altercation. As Kevin sees it, when the boys are not in his care, they’re in danger. If Jamie is charged for “inflicting unjustifiable physical pain on a child,” it will likely be classified as a misdemeanor. The case was submitted to Ventura County District Attorney’s Office for charging consideration.
Jamie Spears is currently Britney’s conservator. He is legally responsible for her care, something which she is actively fighting against.
