Britney is not allowed to testify in court next week in a lawsuit initiated by ex-manager Sam Lutfi, who's suing the Spears for irreparably damaging his reputation, defamation, libel and breach of contract. The October first jury trial will hear from everyone but Britney, including fiancé Jason Trawick, manager Larry Rudolph, Britney's parents Jamie and Lynne and her co-conservators, because conservator judge, Reva Goetz, believes the trial would cause Britney "irreparable harm and immediate danger." 

According to documents obtained by The Fix, Lutfi was set to retain %15 of Britney's gross earnings during his duty as manager, adding up to $120,000 a month.

"[The court documents] state that Lutfi tried to prevent Spears' drug use, allegedly including Adderall abuse, and that after she relapsed in September 2007 he "threw his hands up and walked away." He then moved into her home that October, they continue—the month she lost custody of her children—but only under the condition she stop taking drugs. Overall, the documents claim that the conservators are blocking Britney Spears' testimony not for her own protection, as they say, but because she would refute her family’s claims, including that Lutfi drugged her food and removed her car’s batteries. If Britney Spears could appear in court, they note, she might testify that Lutfi didn't cut off her phones—as was claimed by Britney’s mother, Lynne Spears, in her 2008 book, Through the Storm, as well as in a damning temporary restraining order against Lutfi filed by the Spears family in early 2008."

Britney's representation, her dad/co-conservator Jamie, attorneys Andrew Wallet and Joel Boxer submitted a defense to the judge last week that states:

"[Lutfi] will have ample opportunity to fashion his story to the jury to exploit Britney's absence as a witness at trial: the co-conservators' hands are tied in that regard."

They believe Lutfi's team should not be allowed to sway the jury by implying Britney's absence is voluntary.

Lutfi's lawyer, who refused to comment, insists that if Britney were to appear in court, she'd say Lutfi tried ending her estrangement from her parents and more.

Lutfi's reps also submitted a text message from dad Jamie to Sam on December 17, 2007 that read: “If and when I met u one thing is going to happen I am going to jail and you are going to the hospital.”

Britney Spears allegedly then told Lutfi: "I told you so."

If the Britney situation was the only situation, then maybe i'd think, ok this is fishy, maybe it's possible they're just using him as a fall guy...BUT that's not the case, the reality is that this guy has a list of restraining orders all for similar behavior and THAT is what makes me not trust a word that comes out of this guys mouth!!!

Sam is a manipulating pos. While he was with her and her enabler he had no problem lying to different outlets under his own name and pseudonyms that she was not a drug user. There were even reports he used to score drugs for her. As long as he could stay on the gravy train and bleed her dry he was more than happy to enable and lie for her. Now because of his bogus trial and money is on the line he wants to out his "friend" as a drug user to prove she was already fucked up before he showed up. That maybe so but her supposed drug use has nothing to do with Sam infiltrating her life and making things 10 times worse.

Britney called him "bad people" on FTR, so I doubt she would defend his ass. She knows he did fucked up things.

Sam was hiding her car batteries, dogs, cell phones and drugging her food/drinks BEHIND HER BACK. So it's unclear as to whether she could actually testify to that anyway.
